Welcome to **misuto**. By accessing, subscribing to, or using our website, applications, and somatic tools (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
misuto provides digital tools for emotional regulation, cognitive tracking, and somatic mindfulness (including but not limited to Physiological Sighs, Ocular Pacing, Mist Writing, and diagnostic audits). These tools are provided for personal, informational, and general wellness purposes only.
**misuto is not a medical device, diagnostic system, or clinical therapy tool.** The Service does not provide medical advice, diagnosis, treatment, or professional counseling. Do not use the Service as a substitute for professional medical care. If you are experiencing a psychiatric, psychological, or physical emergency, please immediately call emergency services (e.g., 911 or your local equivalent) or visit the nearest hospital.
To access full features, you are required to register an account. We use **Better Auth** to manage user authentication, which integrates securely with **Google Authentication** as the sole login mechanism. You are entirely responsible for maintaining the confidentiality of your Google account credentials and for all activities that occur under your misuto account. We reserve the right to suspend or terminate your account at our sole discretion if we suspect unauthorized use or security breaches.
Your account details and persistent telemetry logs are stored securely using **Supabase** cloud database services. Certain somatic exercise data (such as the text written during transient writing or offload sessions) is designed to be purely ephemeral, processed locally in-memory, and is not permanently saved or stored on our servers. You acknowledge and agree that our underlying database services are managed by Supabase, and we are not liable for any third-party infrastructure disruptions.
We offer free access levels as well as paid options (including a Single Person Lifetime Access one-time fee of $29). All fees are billed in advance and are non-refundable, except as required by applicable consumer protection laws or at our absolute discretion. We reserve the right to modify pricing, add subscription models, or discontinue features upon reasonable notice.
The Service, including all design assets, software code, user interface, brand styling, texts, and somatic methodologies, is the exclusive intellectual property of misuto and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MISUTO, ITS OPERATORS, DEVELOPERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE USE OF THE SERVICE SHALL NOT EXCEED THE ACTUAL AMOUNT PAID BY YOU TO MISUTO (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50 USD), WHICHEVER IS GREATER.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERRORS-FREE, ACCURATE, OR ENTIRELY FREE OF VIRUSES.
You agree to defend, indemnify, and hold harmless misuto, its operators, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) resulting from or arising out of: (a) your use and access of the Service, (b) your violation of any of these Terms, or (c) any content you submit or transmit through the Service.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Service operators reside, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved exclusively through binding arbitration, rather than in court.
YOU AND MISUTO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
By using misuto, you acknowledge that you have read, understood, and agree to these Terms of Service.
